These Terms and Conditions (“Gift Card Terms”) tell you the legal terms and conditions, which apply and use of physical gift cards both in-store and online.

These Gift card Terms apply to pounds sterling gift cards purchased at the Wigan Warriors Store and online at https://store.wiganwarriors.com

Please read these Gift Card Terms carefully before purchase to ensure that you understand how Gift Cards work and that you are familiar with any restrictions, which may apply to their use.

These Gift Card Terms may be amended from time to time. Whenever you purchase Gift Cards, please check these Gift Card Terms to ensure you understand the terms and conditions, which will apply at that time.

References in these Gift Card Terms to "we", "us" and "our" shall mean (as applicable) Wigan Warriors RLFC.

 

 

1. IN-STORE PURCHASES

 

1.1 You may purchase physical Gift Cards at the Wigan Warriors store in England and also online at https://store.wiganwarriors.com

 

1.2 When you purchase a physical Gift Card at the Wigan Warriors Store, the sale is made to you by Wigan Warriors RLFC, a company registered in England (company number 00174692) with its registered office at Robin Park, Loire Drive, Wigan WN5 0UH). Wigan Warriors VAT number is GB 918 4378 95.

 

 

2. ONLINE PURCHASES

 

2.1 You may purchase physical Gift Cards online through the Wigan Warriors Store Website which will then be mailed to you.

 

2.2 When you purchase a Gift Card online through the Wigan Warriors Store Website, the sale is made to you by Wigan Warriors RLFC, a company registered in England (company number 00174692) with its registered office at Robin Park, Loire Drive, Wigan WN5 0UH). Wigan Warriors VAT number is GB 918 4378 95.

 

2.3 After you place an online order for a Gift Card, you will receive an email acknowledging that we have received your order. This does not mean that we have accepted your order.

 

 

3. PRICE AND PAYMENT

 

3.1 For physical Gift Cards purchased in a Participating Store, the minimum amount that can be loaded on the card is £1.

 

3.2 For physical Gift Cards purchased online through the Wigan Warriors Store Website, the minimum purchase amount is £1.

 

3.3 The maximum amount that can be purchased on any Gift Card is £500.

 

3.4 The price of Gift Cards does not include any chargeable VAT at source and VAT only becomes applicable when making a purchase and part of the payment will satisfy the VAT part of the purchase if VAT is applicable on the sale.

 

3.5 Delivery charges for physical Gift Cards are as notified to you during the checkout process, before you confirm your order. See our website for more details.

 

3.6 Gift Cards purchased online through the Wigan Warriors Store Website must be paid for using a valid credit or debit card. Payment for your Gift Cards and all applicable delivery charges is in advance.

 

3.7 You will own the Gift Card(s) once payment for the Gift Card(s) has been received in full, including all applicable delivery charges.

 

  

4. USING A GIFT CARD

 

4.1 Gift Cards may be used to make purchases online through the Wigan Warriors Store Website and In-store.

 

4.2 Gift Cards are valid for a period of 12 months starting from the date of purchase, following which they expire automatically. A Gift Card cannot be used after the expiry date and any balance remaining upon expiry shall be lost. We have no obligation to remind or inform you of a Gift Card's expiry and it is your sole responsibility to ensure that any balance is used in full prior to expiry. Gift Card balances can be checked at any time upon presentation of the Gift Card in the Wigan Warriors Store.

 

4.3 A Gift Card expires automatically once its balance has been exhausted.

 

4.4 A Gift Card cannot be topped up with additional funds.

 

4.5 Gift Cards may be used to pay for the whole or any part of an in-store purchase or online order. N.B The Gift Card cannot be used to purchase Match Tickets or Events. Any balance which remains due may be paid using any other payment method accepted from time to time by the Wigan Warriors Store Website or In-store.

 

4.6 You may use up to three Gift Cards in payment towards any single “in-store” purchase or one Gift Card if shopping online

 

4.7 These Gift Card Terms apply only to UK pounds sterling Gift Cards purchased from the Wigan Warriors Store Website or Wigan Warriors Store. Gift Cards purchased in accordance with these terms may not be used to make purchases in currencies other than UK pounds sterling. 

 

4.8 Gift Cards may not be used to purchase another Gift Card.

 

4.9 Purchases of Gift Cards do not count towards any qualifying spend relating to other online or in-store Wigan Warriors promotions or offers, including (by way of example only) any "gift with purchase" promotion.

 

4.10 Gift Cards may not be exchanged for cash. No change will be given when payment is made using a Gift Card and any unused balance will remain on the Gift Card for use in relation to future purchases.

 

4.11 Wigan Warriors reserve the right to refuse to accept a Gift Card as payment if there is reasonable evidence of tampering or fraud.

 

 

5. CANCELLATIONS AND RETURNS

Cancelling or Returning your Gift Card

5.1 Gift Cards may only be returned for a refund in accordance with your legal rights in circumstances where a Gift Card is not as described or is damaged or defective (other than as a result of being mishandled or used improperly by you). If you believe a Gift Card may be damaged, defective or not as described, please contact the Wigan Warriors Store Team as soon as possible using the details at the end of these Gift Card Terms.

 

5.2 Gift Card purchases made through the Wigan Warriors Store Website may be cancelled at any time prior to dispatch. However, once you have received your dispatch confirmation email, it will be too late to cancel your purchase and prevent your order from being dispatched.

 

5.3 If you would like to cancel your Gift Card order before you have received your dispatch confirmation email, you must contact the Wigan Warriors Store Team as soon as possible using the details at the end of these Gift Card Terms. Whilst the Wigan Warriors Store Team will attempt to cancel your order prior to dispatch, this may not be possible due to the speed with which orders are processed.

 

5.4 Except as expressly set out in this clause, Gift Cards are non-returnable and non-refundable for any reason.

Returning Purchases made on your Gift Card

5.5 If you use a Gift Card to purchase goods online or in-store and you subsequently return the goods, any refund due to you will be made in the form of a Gift Card.

 

5.6 Where you use a Gift Card and another payment method in the same transaction, any refund due to you will be apportioned between a new Gift Card and the other method of payment you used until the initial payment amount is reached. For example:

- If you buy a shirt for £50 with a £20 Gift Card and pay the remaining £30 by debit or credit card, any refund due to you would be made in the same proportions – you would be given a new Gift Card with £20 credit and £30 would be refunded onto the debit or credit card used.

 

6. LIABILITY TO YOU

 

6.1 You are solely responsible for the safe keeping and security of your Gift Card following delivery. If you damage, destroy or lose your Gift Card or your Gift Card is stolen or used by someone else (with or without your permission), Wigan Warriors shall not be liable for any loss or damage you suffer as a result except to the extent that such loss arises or Wigan Warriors negligence or breach of these Gift Card Terms or the Wigan Warriors Terms and Conditions, in which event the party at fault shall be solely responsible.

 

 

6.2 For the avoidance of doubt, nothing in these Gift Card Terms limits or excludes Wigan Warriors liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for defective products under section 2(3) of the Consumer Protection Act 1987 or for any other matter for which it would be illegal for Wigan Warriors limit or exclude, or attempt to limit or exclude, liability.

 

  

7. DATA PROTECTION

 

7.1 Personal data relating to your purchase or use of a Gift Card will be used in accordance with current Data Protection Legislation and the Privacy Policy which can be found at: https://wiganwarriors.com/club/privacy-policy

 

 

8. VARIATION

 

8.1 These Gift Card Terms may be amended from time to time without notice to you. It is your responsibility to check these Gift Card Terms from time to time to ensure you are aware of any changes which may have been made. In the event of changes, the "Last Updated" date at the top of these Gift Card Terms will be updated accordingly.

 

8.2 Wigan Warriors reserves the right at any time to cancel any Gift Card and/or suspend or permanently discontinue the Gift Card programme altogether to comply with applicable future law or future regulation or as a result of circumstances beyond the reasonable control of Wigan Warriors.

  

 

9. GOVERNING LAW

 

9.1 These Gift Card Terms shall be governed by and construed in accordance with the laws of England, without resort to its conflict of law provisions. Any dispute or claim arising out of or in connection with these Gift Card Terms (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the English courts.
